Estate Planning

Probate and Trust Litigation
Probate is the legal process in which a will is reviewed to determine whether it is valid and authentic. Probate also refers to the general administering of a deceased person's will or the estate of a deceased person who passes without a will. After a person has passed away, a court can appoint either an executor named in the will or an administrator (if there is no will) to administer the process of probate. This typically involves collecting the assets of a deceased person to first pay any liabilities remaining on the person's estate and then to distribute the assets of the estate according to the will or under state law. Generally, the goal of probate is to minimize costs and fees associated with the overall process. Accumulated expenses can include court fees, professional service hours, attorney fees, and administration costs.
