Estate Planning

Polce & Associates, P.C. can help you and your family make plans for a seamless transfer of assets to your spouse, your children, any other person(s) you wish to benefit, and to the charities of your choosing. Our estate planning lawyers help every client consider his or her needs, desires and options under Michigan and federal property and tax laws.  We help our clients craft a comprehensive estate plan that meets their needs.  Our firm prepares wills and trusts designed to meet the client's priorities, resources and responsibilities.  If a trust is not what a client needs, we will not prepare one when a simple will would suffice.  Our office also assists in the review of previously drafted wills and trusts in the event a client’s situation or desires have changed.  Our firm can prepare living wills along with the requisite health care power of attorney documents to ensure the designated representatives of each client are recognized by the client's physicians and health care providers.


Probate and Trust Litigation

Probate is the legal process in which a will is reviewed to determine whether it is valid and authentic.  Probate also refers to the general administering of a deceased person's will or the estate of a deceased person who passes without a will.  After a person has passed away, a court can appoint either an executor named in the will or an administrator (if there is no will) to administer the process of probate. This typically involves collecting the assets of a deceased person to first pay any liabilities remaining on the person's estate and then to distribute the assets of the estate according to the will or under state law. Generally, the goal of probate is to minimize costs and fees associated with the overall process. Accumulated expenses can include court fees, professional service hours, attorney fees, and administration costs. At Polce & Associates, P.C., we offer our clients representation in all aspects of probate proceedings, including complex trust litigation.
